1. Acceptance of Terms

By accessing or using any Discord bots or other services (collectively, the "Services") provided by Geneplore AI ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

You must be at least 13 years old to use our Services. If you are under 18, you represent that you have permission from a parent or guardian to use our Services.

2. Description of Services

Geneplore AI provides AI-powered Discord bots and related services that enable users to interact with various AI models and tools. Our Services may integrate with third-party platforms including Discord, OpenAI, Stability AI, Google, Replicate, RunPod, Meta, and MongoDB Atlas.

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice.

3. User Accounts and Eligibility

To access certain features of our Services, you may need to create an account or subscribe to a paid plan. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that your account information is accurate and up-to-date

We reserve the right to refuse service, suspend, or terminate accounts that violate these Terms or engage in abusive behavior.

4. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You will not:

  • Use our Services for any illegal, fraudulent, malicious, or harmful purposes
  • Harass, threaten, abuse, or harm other users
  • Attempt to reverse engineer, decompile, modify, or exploit our Services or underlying technology
  • Distribute spam, malware, viruses, or other harmful content
  • Circumvent or attempt to circumvent any security features or usage limitations
  • Use our Services in any manner that could damage, disable, or impair our infrastructure
  • Violate the terms of service of any third-party platforms integrated with our Services (including Discord, OpenAI, and others listed in Section 2)

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your access to our Services.

5. Subscriptions, Credits, and Payments

5.1 Credits System

Our Services may operate on a credit-based system. Credits are virtual units used to access certain features and are subject to the following terms:

  • Credits have no cash value
  • Credits are guaranteed for a minimum of three (3) months from the date of your last active subscription
  • We reserve the right to add or remove credits from your account to correct errors, prevent abuse, or for promotional purposes
  • Unused credits may expire after three (3) months of subscription inactivity, with at least thirty (30) days' advance notice provided to active users

5.2 Refunds

Refund requests must be submitted within fourteen (14) days of purchase. We will review refund requests on a case-by-case basis and reserve the right to approve or deny any request at our discretion.

Refunds will not be provided if:

  • Your account has been terminated for violating these Terms
  • You have initiated a chargeback or payment dispute

5.3 Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute with your financial institution:

  • All credits associated with the disputed transaction will be immediately removed
  • Your account may be suspended or terminated
  • You may be prohibited from using our Services in the future

We encourage you to contact us at support@geneplore.com before initiating any payment dispute.

6. Data Collection and Privacy

6.1 Data We Collect

By using our Services, you acknowledge and agree that we may collect and store:

  • Message content from threads created by our bots
  • User IDs and Discord thread IDs
  • Server (Guild) IDs and names (if Guild Credits feature is enabled)
  • Moderation flags and related message content (in servers with AIMod enabled)

6.2 How We Use Data

We use collected data to:

  • Provide and improve our Services
  • Power our credit and subscription systems
  • Prevent abuse and ensure platform security
  • Comply with legal obligations

6.3 Data Retention

  • Conversation data is stored until you request deletion
  • User IDs and Thread IDs are retained for the duration of our credit system operations
  • You may request deletion of your account and conversation data at any time through the /home command, clicking User Settings, and selecting "Delete Account"

7. Moderation and Content

We reserve the right to review, flag, and store messages that violate our Acceptable Use Policy or trigger our moderation systems, particularly in servers where AIMod is enabled. We do not guarantee that we will monitor all content, and you use our Services at your own discretion.

8. Third-Party Services

Our Services integrate with third-party platforms and services. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

9. Intellectual Property

All content, features, and functionality of our Services, including but not limited to software, text, graphics, logos, and trademarks, are owned by Geneplore AI or our licensors and are protected by intellectual property laws.

You retain ownership of any content you create using our Services, but you grant us a limited license to use, store, and process your content as necessary to provide our Services.

10. Disclaimers and Limitation of Liability

10.1 Service Availability

Our Services are provided on an "as available" basis. While we strive to maintain reliable service, we do not guarantee uninterrupted access or error-free operation. We are not responsible for:

  • Service interruptions or downtime
  • Errors or inaccuracies in AI-generated content
  • Loss of data due to technical issues
  • Third-party service failures

10.2 Limitation of Liability

To the maximum extent permitted by law, Geneplore AI and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from:

  • Your use or inability to use our Services
  • Unauthorized access to or alteration of your data
  • Any conduct or content of third parties on our Services
  • Any other matter relating to our Services

In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability shall be limited to the maximum extent permitted by law.

10.3 AI-Generated Content

AI-generated content may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing and verifying any AI-generated content before using it. We make no representations or warranties regarding the accuracy, reliability, or appropriateness of AI-generated content.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of these Terms
  • For significant changes, provide at least thirty (30) days' advance notice when reasonably possible

Your continued use of our Services after changes to these Terms constitutes acceptance of the revised Terms. If you do not agree to the changes, you must discontinue use of our Services.

12. Termination

12.1 Termination by You

You may stop using our Services at any time. If you wish to delete your account and associated data, please contact us at support@geneplore.com.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice, particularly in cases involving:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of our Services or other users
  • Non-payment of fees

Upon termination, your right to use our Services will immediately cease, and we may delete your account and associated data.

13. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and North Carolina, without regard to its conflict of law provisions.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Geneplore AI regarding our Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Disputes

Any disputes arising from these Terms shall be resolved in the courts of North Carolina, and you agree to submit to the personal jurisdiction of such courts.

Before filing any legal action, you agree to first contact us at support@geneplore.com to attempt to resolve the dispute informally for at least 30 days.
